When it comes to critical race theory, it is asserting that race is a social construct. For example, it does not matter what you identify as, whether you are white, black or asian. What society has deemed you to be is socially constructed because there is no biological difference between any of the human races. A black man can donate his organs to a white man, and the white man will survive because biologically there is no difference.
Critical race scholars argue that although people do not normally support racism publically and the United States laws are perceived to be non racist, there are still laws in place that these scholars would call into question. One law would be stop and frisk laws that are meant to keep police and the community safe during an investigation, they target people of color proportionally more than caucasian people and scholars would say unfairly profile people of color.
POC are more likely to get profiled due to the way they are dressed or simply for being a shade darker. We see examples of the stop and frisk laws throughout platforms such as social media in videos posted to show awareness where a police officer will abuse his power without reasonable suspicion and get upset when the alleged perpetrator knows his or her rights. Another law such as a loitering ordinance brings up the same issues as the aforementioned law.
POC are proportionally more likely to get arrested for spending time in a specific area, therefore scholars would argue that laws like loitering ordinance and stop and frisk are examples of systemic racism. A person of color is more likely to get the police called on them for simply doing regular things such as moving in to a new neighborhood or sitting on their own porch.
