Final Project Case Review
The final project for this course is the creation of a case review. As a human services practitioner, you could be in a position that requires you to review medical records and to be aware of all related federal and state laws and statutes and healthcare mandates (e.g., the Joint Commission for Accrediting Hospital Organizations [JCAHO], which governs most hospitals). You will be reviewing a case study to determine what legal and ethical issues need to be considered when deciding if it is appropriate to divulge the information requested. The project is divided into three milestones, which will be submitted at various points throughout the course to scaffold learning and ensure quality final submissions. These milestones will be submitted in Modules Two, Four, and Five. The final submission is due in Module Seven. In this assignment, you will demonstrate your mastery of the following course outcomes: · Evaluate human services agencies’ decisions regarding appropriate court reporting practices for the extent to which they are ethical and legal · Analyze the codes of ethics for their relationships to human services laws, regulations, and national standards · Interpret legal documents for determining appropriate usage of court terminology and legal practices related to the release of health information and confidentiality · Recommend appropriate legal strategies that encompass current codes of ethics, human services laws, regulations, and national standards Case Study Stephanie is a human-services policy analyst who works with the state-run psychiatric hospital system. Her job is to facilitate discharges of patients to the community by coordinating with local mental-health centers and providers of care to make sure that the patient has adequate and immediate post-discharge care. Stephanie received a call from a parole officer of a 25-year-old undocumented-immigrant patient named Kevin, who was in the hospital. The parole officer indicated that Kevin violated parole by abusing illegal substances prior to the admission to the state hospital. The parole officer asked questions about Kevin’s diagnoses, where he was being discharged to, and the staff involved in his care while he was hospitalized. You have been asked to determine if Stephanie can legally and ethically answer these questions and provide confidential health information about Kevin to the parole officer. Prompt Based on your analysis of federal and state laws and applicable regulations that govern human services practices that have been covered in this course, what ethical and legal considerations should be addressed to determine what healthcare and other confidential information can be released, and who can receive it, according to the case scenario provided? In a case where health records were to be released to a court, what would you do to prepare for court? Include other issues that should be considered by agencies or hospitals to ensure compliance when releasing healthcare and other confidential information. II. Review of the Case Based on your analysis of the codes of ethics and legal considerations in human services, create strategies to address questions about the case. A. What information can be released to the parole officer? What information should not be released to the parole officer? Justify your responses. B. If information is released that should not be, what are the legal ramifications for the human services policy analyst and her organization? Justify your claims with relevant, scholarly research. C. What are the ethical issues that would arise for a human services professional and her organization due to releasing information that should not be released? Recommend appropriate strategies to mitigate identified ethical issues. D. Include other issues that should be considered that are specific to this case scenario and related to compliance with NOHS ethical standards and laws that govern the human services field. Justify your claims using concrete, relevant examples. III. Conclusion After analyzing the NOHS ethical standards and legal considerations and applying your strategies to the case, compose a conclusion addressing the following and support your ideas with citations from your research: A. Overall, what are the key ethical considerations to be addressed in a hospital setting? Explain why. B. What laws or regulations are critical to releasing healthcare and other confidential information to a court? C. Evaluate additional strategies that might prevent a lawsuit that a human services agency could incorporate into policies or practices. D. What do you recommend human services agencies do to prepare for the release of health records to a court? Use concrete evidence to substantiate claims. Milestones Milestone One: Draft of Introduction In Module Two, you will submit a draft of the introduction of your case review, including all critical elements listed in Section I above. Review the Ethical Standards for Human Services Professionals. Analyze the NOHS ethical standards that relate to the release of health information and how they correlate with the Health Insurance Portability and Accountability Act (HIPAA) of 1996. Include the major legal concerns that have arisen by allowing the release of health information. Review legal and ethical considerations when releasing confidential patient information to other providers of care while receiving services and upon discharge from a hospital. Conduct an analysis of the challenges faced by agencies holding health information and how these issues are commonly resolved. Review strategies used by other large health and human services agencies to prevent lawsuits being brought against them. This milestone is graded with the Milestone One Rubric. Milestone Two: Draft of Review of Case In Module Four, you will submit a draft of the review of the case, including all critical elements listed in Section II above. Using the information reviewed for Milestone One, discuss information that can and cannot be released to a parole officer, particularly information about an individual who has a substance abuse diagnosis along with mental illness, and is being discharged from a psychiatric facility to the community. A state statute from your state of residence can provide information related to parole of individuals previously incarcerated. Provide an example of how an inappropriate release of confidential information can be remediated in order to prevent a lawsuit against the human services professional (HSP) and/or the agency. The State Departments of Health and Human Services have information related to this issue. Make sure to review both federal and state statutes to gain a more comprehensive viewpoint. This milestone is graded with the Milestone Two Rubric. Milestone Three: Draft of Conclusion In Module Five, you will submit a draft of the conclusion, including all critical elements listed in Section III above. The conclusion should include ethical and legal considerations. From the analysis, provide ideas about policies that could be utilized more effectively to prevent the misuse of health and confidential information. The State Department of Health and Human Services often provides statewide policies and rules that align with mandated state statutes. This milestone is graded with the Milestone Three Rubric. Final Submission: Case Review In Module Seven, you will submit your case review. It should be a complete, polished artifact containing all of the critical elements of the final product. It should reflect the incorporation of feedback gained throughout the course. This submission will be graded using the Final Project Rubric.
