Each paper must be between two and three pages and be double-spaced, with 12-point font and one-inch margins. Each paper is worth 5 points, for a total of 15 points for the three papers. The papers must be double-spaced, 12-point font and one-inch margins. The topics are posted below. You may choose more than one topic to meet the minimum page requirement. Make sure you identify which topic(s) you are addressing in the paper. Paper will be submitted on Canvas. If you use outside sources to address the topic, you must cite your work. Include a title page that includes your name (this does not count as one of your pages).
The Alford guilty plea permits a defendant to enter a guilty plea while at the same time protesting his innocence. Defendants seek to use an Alford plea when they want to avoid the greater sentence they generally face if they take their case to trial and lose. What do you see as the advantages and disadvantages of the courts allowing the use of the Alford Plea? If it was up to you, would you allow the Alford Plea to be used? Why or why not?
In everyday life, we judge other people not only by what they say but also to some extent by their appearances and their conduct. Do you feel that the demeanor of witnesses can and does affect the outcome of a trial? Why or why not? Do you feel it is possible for a witnesses’ demeanor to affect his/her credibility while testifying? If so, could not this be used as a tactic by either the prosecution or defense to strengthen their case?
Each adversary (prosecution and defense) seeks to present the facts that are most advantageous to its position. Each adversary also seeks to prevent and make it difficult for the opponent to do the same. Do you feel that this adversarial system may actually hinder the finding of the truth? Why or why not? Provide examples that support your decision.
