” Explain this concept and how it applies in this situation. Explain what you see to be DSU’s competitive advantage and how this will relate to this project.4. In anticipation of an extremely successful football season, 15 dozen Fighting Okra tee shirts and 15 dozen Statesman tee shirts are ordered and are to be delivered by August 15th. The order actually arrives on July 15th; however, the Statesman image is placed with the Fighting Okra wording on the shirts, and the Fighting Okra image is placed with the Statesman wording. What are the legal ramifications of this delivery? What if Delta State does not discover the error until the day before the opening football game? What will you do? Part A Answers Part a There are a list of challenges when it comes to productions of the mascot and related items. These challenges include forecasting demand for a product, it is difficult to know exactly how much product there will be a demand for therefore it is possible to run into the problem of having too much or too little product. Controlling inventory is also a challenge that may present itself as well as skilled labor shortage, although automation has been at the forefront of manufacturing and has been able to wedge the labor gap, human capabilities will still be needed to analyze and manage output and handle quality control. Just like production, marketing comes with a few challenges as well such as not knowing exactly what product or service you want to offer or not knowing your specific market are two of the biggest challenges facing marketing. It is vital to have a great marketing plan in place for whatever product you plan to present to the public. As a brand, it is very important to have some sort of online presence to gauge what your target market is actually into.
Organizational culture is the expectations, assumptions, beliefs and values that guide and inform the action of all team members. There are four types of organizational culture such as: clan culture which tends to be based on values and norms associated with the firm. Hierarchical culture values and norms associated with hierarchy. Market culture has a primary objective of productivity, planning and efficiency. Lastly, adhocracy culture in which growth, resource acquisition and innovation are most important. Both clan and adhocracy culture depend on individual traits and responses, whereas market and hierarchical culture focuses more on organizational goals rather than individuals. I prefer clan culture when it comes to business development because it’s more common to find people with the same traits and it becomes easier to contribute with like-minded individuals to reach a common goal. Competitive advantage is a condition which allows a firm to produce a good or service at a lower rate and in a more desirable form for customers. Competitive advantage is attributed to cost structure, brand, distribution network, intellectual property, customer support and quality of the product offered. DSU’s competitive advantage is the uniqueness of the mascot, no matter where you are, you’ll always recognize that fighting Okra. There are multiple schools with tigers, lions and bears as mascots but DSU Okra is one of a kind. Taking into consideration that the order was delivered well before time there are no legal issues that should arise in this case. However, the products were misprinted, the legal ramifications presented is that the actual manufacturer will be required to replace the misprinted t-shirts and provide a replacement order of corrected t-shirts. Failure to do so, can result in a lawsuit from the sports organizing committee and the manufacturer will be required to compensate for the number of misprinted t-shirts and whatever legal fees occur. If the mistake is not discovered until the day of, I would get in contact with the manufacturer immediately to attempt to remedy the problem and request a refund for the misprinted products. The College of Business and Aviation enters into a contract with Quality Tee Shirts to manufacture Fighting Okra, Statesmen, and Lady Statesmen tee shirts according to certain specifications. Quality Tee Shirts produces several before making the entire order, and these several are inspected and approved by the College of Business. One week before the contracted shipment date, Quality Tee Shirts “requests” an increase in price due to an increase in materials costs outside its control. What should the College of Business do?2. College of Business and Aviation officials confer with you over the above situation, and then you learn that Quality Tee Shirts is teetering on the brink of bankruptcy. You also learn that it is upheld as a standard of excellence for its observance of all applicable OSHA standards and EEOC requirements. Now, what do you do?

One week before the contracted shipment date, Quality Tee Shirts “requests” an increase in price due to an increase in materials costs outside its control. What should the College of Business do? Business Law and Management Theory Discussion
Firstly, when the College of Business enters into a contract with Quality Tee Shirts, it has fixed a rate for the t- shirts ordered. Although the cost of the production has increased, which led the t- shirt production company to ask for an increase in the price due to increase in material, which was out of its control.
Taking into consideration that a contract was read and agreed upon, there’s an agreement between Quality Tee Shirts and the College of Business, the price within the contractual agreement should be the final cost. Quality Tee Shirts can begin to charge the new prices on future productions but considering a price had been agreed upon before the price increase, Quality Tee Shirts has an obligation to produce the product at the agreed upon price. If the t- shirts quantity and quality are not produced and delivered at the agreed upon price by Quality Tee Shirts on the date discussed in the agreement, the College of Business can and should seek legal action against Quality Tee Shirts. College of Business and Aviation officials confer with you over the above situation, and then you learn that Quality Tee Shirts are teetering on the brink of bankruptcy. You also learn that it is upheld as a standard of excellence for its observance of all applicable OSHA standards and EEOC requirements. Now, what do you do? If we consider it on humanitarian grounds, we should definitely pay as per the new price. Since no one wants to do business in losses.
But taking into consideration, the increase in the prices depend on market factors and not individual personal factors, I would advise that The College of Business should consider a price rise and pay off the additional cost to Quality Tee shirts in order to assist Quality Tee Shirts. Business Law and Management Theory Discussion
If Quality Tee Shirts continues business, the College of Business should receive a small discount due to the last-minute price increase of the previous t- shirt order. It is vital that the College of Business knows that as a business with a contract with Quality Tee Shirts in the event that the business does file for bankruptcy, the court will typically send out a notice and a proof of claim form that allows you to petition for payment. If you do not receive a proof of claims form, it is important to reach out to the courts because Quality Tee Shirts is legally obligated to pay all outstanding debt in the event of bankruptcy.
